When you apply for an operators licence you make a legal declaration to undertake to keep your vehicles in a roadworthy condition. Part of complying with this undertaking is to ensure your drivers carry out daily walk around checks of your vehicles.
The checks should cover the external condition of their vehicle, ensuring in particular that the lights, tyres, wheel fixings, bodywork, trailer coupling, load are all in a serviceable condition. Drivers must be able to report any defects that could prevent the safe operation of the vehicles and there must be documentation to support the process. Whatever system you have in place it is imperative that the appropriate Defect Management System complies with your legal requirements and protects you from revocation, curtailment, or suspension of your operators licence by the Traffic Commissioner.
In addition Drivers may be prosecuted for the existence of defects found on the vehicles they drive by way of a Graduated Fixed Penalty enforceable at the roadside by DVSA. However it is the operator’s responsibility, to ensure that these checks are carried out and documented.
